Description

The procedure concerns the issuance of an authorisation to engage in the occupation of road haulage operator or the renewal of the authorisation to engage in the occupation of road haulage operator. In the case of an application for the renewal of the authorisation to engage in the occupation of road haulage operator due to its expiry, all the supporting documents relating to the issuance of the authorisation to engage in the occupation of road haulage operator shall be submitted, in addition to the expired authorisation (document) to engage in the occupation of road haulage operator.

The authorisation to engage in the occupation of road haulage operator shall be granted to transport undertakings established in Greece and engaged in the occupation of road haulage operator by means of motor vehicles or combinations of vehicles of any Maximum Permissible Laden Weight (MPLM) of a Vehicle.

Transport undertakings include

  • (a) natural persons residing in Greece who are nationals of a Member State of the European Union or of the Single Economic Area, or are of proven Greek descent (aliens of Greek ethnic origin) or are third country nationals who can access the occupation of road haulage operator in accordance with Greece’s international commitments, and
  • (b) commercial companies incorporated in accordance with Greek law and with their registered office in Greece. The authorisation to engage in the occupation of road haulage operator shall have a maximum validity of five (5) years.
Where any of the supporting documents, with the exception of the insurance policy or the certificate of insurance coverage submitted for proof of financial standing, have a period of validity of less than five (5) years, the authorisation to engage in the occupation of road haulage operator shall be issued for a period equal to the validity of that supporting document.

In the application, the transport undertaking shall indicate the e-mail address at which it will receive notifications from the competent authority.             • 1 Establishment The undertaking has an effective and stable establishment in Greece.

            • 2 Conditions for non-commission of criminal offenses The undertaking shall be of good repute. The owner of the transport undertaking must be of good repute, where the undertaking is an individual undertaking, or its legal representative must be of good repute, where the undertaking is a legal person, and, at the same time, so must the transport manager, if it is a different person. Any of these natural persons are not of good repute if (a) they have been irrevocably sentenced to any penalty in the past 10 years prior to the submission of the application for smuggling, transport of irregular migrants, drug-related offences, sex trade, human trafficking, slave trade, sexual violence, and economic exploitation of sexual health, murder, attempted murder, fraud, theft, embezzlement, forgery, use of false documents, robbery, kidnapping, formation of a criminal organisation, terrorist act; (b) they have been irrevocably convicted at least twice in the 8 years prior to the submission of the application, with a custodial sentence of at least six (6) months for offences of a commercial nature; (c) they have been irrevocably convicted at least twice, in the 8 years prior to the submission of the application, with a custodial sentence for violations of the provisions the law on the transport of goods or passengers or professional liability; (d) they have been irrevocably convicted at least twice in the 8-year period prior to submission of the application, with a custodial sentence for violations of the provisions of the law on the salary and work conditions of the occupation; (e) they have been irrevocably convicted at least twice during the five years prior to the submission of the application, with a custodial sentence of at least six (6) months for violations of the provisions of the Road Traffic Code; (f) they have been irrevocably convicted at least twice in the 8 years prior to the submission of the application, with a custodial sentence of at least six (6) months, for at least two violations of the provisions of points (b), (c), and (d) above; (g) they have been declared bankrupt during the five years prior the submission of the application. The impediment of cases (a) to (g) shall cease to exist if the penalty is commuted.

            • 3 Financial The undertaking shall have financial standing at least equal to EUR 9 000 for the first motor vehicle used, EUR 5 000 for each additional motor vehicle or combination of used vehicles with an MPLM exceeding 3.5 tonnes; and EUR 900 for each additional motor vehicle or combination of vehicles used with an MPLM not exceeding 3.5 tonnes.
