The procedure concerns the announcement of commencement and the granting of a certificate of compliance with the legal conditions for the operation of: (a) vine stock nurseries and (b) undertakings producing and marketing propagating material of agricultural plant species:

- seed production undertakings;

- type A, B and C nurseries; and

- type A and B undertakings marketing propagating material.

It also concerns the procedure for reviewing compliance with the legal conditions for the operation of the above undertakings and changes in the status of the above undertakings and the removal of the above undertakings from the register.

Fees

An appeal may be filed against the removal of the licence to operate/removal of the undertaking from the register only, not against the non-registration of an undertaking. After a three-month period, the undertaking may operate, but a Certificate of Compliance with Legal Conditions (valid for 5 years) or a written notification about the prohibition of commencement (within 3 months) or a prohibition on continuing its operation (after 3 months) shall always be issued. In the event of a prohibition, a one-month period shall be allowed for the applicant to comply before it is issued.

3 Labour The applicant must employ a qualified agronomist that holds a degree from a university or a graduate of the Greek technological sector, specialising in the activity of the undertaking, as evidenced by the legislation on professional rights currently in effect, or a graduate of a corresponding speciality in schools of another EU Member State or a holder of an equivalent degree or diploma from schools in countries outside the EU. Staff who are equally trained in producing and marketing propagating material, as set out in Presidential Decree 145/2014 (GG I/235), or staff who are equally trained in other Member States in the production and marketing of propagating material may also be employed as a scientist, as set out in case (3) of subparagraph E.10 of paragraph E of the first Article of Law 4152/2013, as amended by Article 120 of Law 4472/2017 (on Vine Stock Nurseries).

4 Labour It shall employ a qualified agronomist that holds a degree from a university or a graduate of the Greek technological sector specialising in the activity of the undertaking, as this correlation can be evidenced by the legislation on professional rights currently in effect, or a graduate of a corresponding speciality in schools of another EU Member State or a holder of an equivalent degree or diploma from schools in countries outside the EU, specially trained for at least six months in an institution in Greece or abroad or by further training on the subject (the latter applies only to type C nurseries). The scientist may also employ staff that has undergone equivalent training in producing and marketing propagating material, as set out in Presidential Decree 145/2014 (GG I/235) or staff equally trained in other Member States in producing and marketing propagating materials, in accordance with case (3) of subparagraph E.10 of paragraph E of Article 1 of Law 4152/2013 (GG I/107), as amended by Article 120 of Law 4472/2017 (for Vine Stock Nurseries).

7 Administrative It must be installed in an irrigated area, whether privately owned or not, and have facilities and mechanical equipment depending on the type of propagating material it produces (rootstock cuttings for grafting, nursery cuttings or top-graft cuttings) (For vine stock nurseries).

8 Environmental The irrigated land shall be free from any developed trees or shrubs, it shall be in favourable climate conditions and not have been used for vine cultivation purposes at least in the last ten (10) years. In terms of plant health, it shall not be in a zone that is affected by communicable diseases or pests, especially nematodes. Soil samples shall be taken by the scientist and sent to a laboratory for nematode testing (for vine stock nurseries).

9 Environmental Type A, B and C nurseries shall be installed on irrigated land, whether privately owned or not, free from any developed trees or shrubs, and the land should be in favourable climate conditions. In terms of plant health, the soil must not be in a zone that is affected by communicable diseases or pests, and must be free from nematodes. Soil samples must be taken by the scientist and sent to a laboratory for nematode testing. In cases where disinfected crop substrates (mixed soil) are used, as defined in Article 1(2)(e) of Law 1565/1985 (GG I/164), sampling and analysis of the substrate is not required (for undertakings producing and marketing or marketing propagating material).

10 Technical There shall be no vineyards with inferior quality material or common vine varieties grown around the land on which the stock nursery is to be set up within a distance of twenty (20) metres.

11 Technical Conditions depending on the undertaking category: a) Seed production undertaking: It has the appropriate infrastructure, namely the facilities for the processing, packaging and storage of propagating material, with machinery appropriate to the specialisation of the undertaking, such as greenhouses or cages for vegetable seed production, where necessary. b) Type A, B, C nurseries: It has facilities and machinery that correspond to the groups of propagating material and the plant species whose propagating material is produced. c) Type A marketing of propagating material: It has storage and packaging facilities and mechanical equipment corresponding to its activities. d) Type B marketing of propagating material: It has storage facilities appropriate and corresponding to its activities (for undertakings producing and marketing or marketing propagating material).

12 Technical Conditions depending on the undertaking category: a) Seed production undertaking: It has a seed analysis laboratory with germination control rooms, precision hygrometers, as well as auxiliary technical equipment. Where the undertaking is engaged exclusively in the reproduction of potato tubers for planting, the conditions laid down in the preceding passage do not have to be fulfilled. It has a safety storage chamber for basic propagating material and previous generations, provided that material of the categories referred to in Article 3(2)(b) and (c) of Law 1564/1985 is reproduced. b) Type C nursery: It has a tissue culture laboratory with a satisfactory degree of isolation from the other areas of the undertaking. It must include the following areas: 1. a preparation area, 2. utility areas, 3. a refrigeration room or refrigerator, 4. crop growing room and 5. aseptic tissue and crop cutting area. Its equipment must include: 1. an aseptic bank or aseptic area; 2. a sterilisation device for nutrients, crop tools and containers; 3. PH metre; 4. stereoscope; 5. scale; and 6. Water distillation or deionisation device. c) Type A marketing of propagating material: It has a laboratory to determine the germination and specific purity of seeds. This obligation does not apply to any undertaking marketing propagating material which markets exclusively propagating material of agricultural plant species, other than seeds, which does not require checking its germination and specific purity.
