The application by the organisation shall be submitted to the Directorate for Addiction Treatment of the Ministry of Health and must be accompanied by a dossier of supporting documents as described in Article 7(3) of Ministerial Decision No Δ2α/Γ.Π.οικ.119/2-1-2025 (Government Gazette, Series II, No 16).

Description
After the third subparagraph of Article 58(2) of Law No 4139/2013 (Government Gazette, Series I, No 74), new fourth, fifth and sixth subparagraphs are added as follows: The competent authority for the establishment, oversight and revocation of operating permits for Counselling Centres, physical and mental rehabilitation and social reintegration Centres or other such non-profit units beyond those recognised under Article 51 is the Ministry of Health, following a recommendation from the National Committee for Drug Policy Planning and Coordination. A decision of the Minister of Health shall determine the basic principles and specifications, terms, conditions, supporting documents, procedure and any other matters relating to the granting of operating permits for the above units. Legal or natural persons operating rehabilitation programmes or providing rehabilitation services without the required permit shall be liable to imprisonment of between three (3) months and one (1) year and an administrative fine of EUR 30 000 to EUR 50 000. The administrative fine shall be imposed by decision of the Governor of the relevant Health Authority. A Joint Ministerial Decision of the Ministers of Health and Finance shall determine the imposition procedure as well as any other issue relating to the imposition and collection of said administrative fine. Organisations operating rehabilitation programmes or providing rehabilitation services without the necessary permit must submit an application for a permit by 31 December 2022.

Description
Programming to address substance addiction within the meaning of Article 1 is divided into three levels:
a) prevention – awareness
b) therapeutic rehabilitation
c) social reintegration.
The competent authority for the establishment, oversight and revocation of operating permits for Counselling Centres, physical and mental rehabilitation and social reintegration Centres or other such non-profit units beyond those recognised under Article 51 is the Ministry of Health, following a recommendation from the National Committee for Drug Policy Planning and Coordination.
A Joint Ministerial Decision of the Ministers of Justice, Transparency and Human Rights and Health shall approve the programmes implemented at detainment facilities.
