3 Medical In the case of an individual enterprise, the applicant must not be suffering from or have been hospitalised for a major mental disorder or serious personality disorder. In any other case of a legal person, this requirement applies to all the representatives and managers in the case of joint-stock companies and limited liability companies and of general partners in the case of general and limited partnerships.

4 Conditions for non-commission of criminal offenses In the case of an individual enterprise, the applicant must not have been irrevocably convicted of a. any misdemeanour prosecuted ex officio and committed with intent, for which a prison sentence of at least 2 years was imposed and b. any misdemeanour provided for by the provisions of Law 2168/93 and Law 3500/2006. Τhe applicant must also not have been prosecuted for: a. acts punishable to the degree of a felony, b. violations of the laws on drugs and protection of society from organised crime, terrorist acts, violations of provisions concerning fishing with explosives or toxic substances and violations of article 15 of Law 2168/93, c. acts provided for in Law 3500/2006. Description After the examination of the submitted supporting documents, a three-member committee, headed by an officer, is appointed to check the company to ensure that the security conditions imposed are met.

Notes In the case of a factory or laboratory or warehouse licensed by the Ministry of Development an examination may be carried out for the completeness of the security measures imposed, provided that this is easy to ascertain and does not require special technical knowledge from the police officers, in which case the assistance of a specialised official of the competent local office of the Ministry of Development will be requested and a report will be drawn up.

5 Adoption of a decision of the three member Committee.

Description The Committee shall, following its examination of the enterprise, adopt a relevant decision. If the enterprise doesnt comply with the safety measures imposed, the necessary measures shall be indicated in writing within a specified period, after which the enterprise shall be inspected again. If the person concerned fails to comply with the above instructions, he shall be informed that his application will be rejected.
