The interested party (person or legal entity) notifies – electronically - the competent authority for (a) any changes in the Entity providing the activity or (b) any changes in the data and information already registered in the initial notification for the establishment and commencement of operations of a a Food Service Establishment at a specific place or premise.

|process_remarks=The interested party (person or legal entity) sends an online notification to the competent authority about the change of the activity provider or the change of the data declared during the initial notification on the establishment and opening of a Food Service Establishment (FSE) in a certain place or establishment.

Note:

* In case of a change in the registered office of the establishment, which constitutes a change of the establishments location, the entity shall make a new notification (paragraph 5 of article 6 of Law 4442/2016).

* In case of cessation of any of the activities declared in the notification, the party concerned shall also make a change to the notification.
 +
* In case of death of the entity as a person: the legal heir must change the details of the notification within 4 months from the date when he/she became aware of the induction, stating in the change of the notification the number of the decision of the relevant Court of First Instance by which the will was published, as well as the certificate of the same court on the non-publication of another will. If the will is a personal will, the above court must declare the will to be the main will. If there is no will, the new body must indicate the number of the succession (Articles 1956 et seq. of the Civil Code). Until the issue of the probate certificate, it is possible to declare a change in the notification in the name of the person concerned, provided that the certificate of next of kin and their responsible declarations on the continuation of the activity by the person concerned is declared (or sent electronically) to the relevant municipality. The new entity is responsible for the operation of the establishment from the day of the change declaration. The new operator must produce the above documents to the competent control authorities on request.

Σημείωση:

- Σε περίπτωση που η μεταβολή αφορά την αλλαγή έδρας του καταστήματος που συνιστά μεταβολή της εγκατάστασης του καταστήματος, ο φορέας προβαίνει σε νέα γνωστοποίηση (παρ.5 του άρθρου 6 του Ν.4442/2016).
 
−
- Σε περίπτωση παύσης κάποιας από τις δραστηριότητες που δηλώθηκαν στη γνωστοποίηση, ο ενδιαφερόμενος προβαίνει επίσης, σε μεταβολή της γνωστοποίησης.
 
−
- Σε περίπτωση θανάτου του φορέα ως φυσικού προσώπου: ο νόμιμος κληρονόμος του οφείλει να μεταβάλει τα στοιχεία της γνωστοποίησης εντός 4 μηνών από τότε που περιήλθε σε γνώση του η επαγωγή, δηλώνοντας κατά τη μεταβολή της γνωστοποίησης τον αριθμό απόφασης του οικείου Πρωτοδικείου με το οποίο δημοσιεύτηκε η διαθήκη, καθώς και του πιστοποιητικού του ίδιου δικαστηρίου περί μη δημοσίευσης άλλης διαθήκης. Σε περίπτωση κατά την οποία η διαθήκη είναι ιδιόγραφη, απαιτείται από το ανωτέρω δικαστήριο η κήρυξή της ως «κυρίας». Αν δεν υπάρχει διαθήκη, ο νέος φορέας οφείλει να δηλώσει τον αριθμό κληρονομητηρίου (άρθρα 1956 επ. Αστικού Κώδικα). Μέχρι την έκδοση του κληρονομητηρίου είναι δυνατή η δήλωση μεταβολής της γνωστοποίησης στο όνομα του ενδιαφερομένου, υπό την προϋπόθεση δήλωσης (ή ηλεκτρονικής αποστολής) στον οικείο δήμο του πιστοποιητικού εγγύτερων συγγενών και υπευθύνων δηλώσεων αυτών περί της συνέχισης της δραστηριότητας από το συγκεκριμένο πρόσωπο. Ο νέος φορέας ευθύνεται για τη λειτουργία του καταστήματος από την ημέρα της δήλωσης μεταβολής. Ο νέος φορέας οφείλει να επιδεικνύει τα ως άνω έγγραφα στις αρμόδιες ελεγκτικές αρχές εάν του ζητηθούν.

Description

The procedure concerns the Amendment of the Notification of the Establishment and Operation of a Food Service Establishment and is addressed to citizens and legal entities. The interested party (person or legal entity) notifies – electronically - the competent authority for (a) any changes in the Entity providing the activity or (b) any changes in the data and information already registered in the initial notification for the establishment and commencement of operations of a a Food Service Establishment at a specific place or premise.

The interested party (person or legal entity) sends an online notification to the competent authority about the change of the activity provider or the change of the data declared during the initial notification on the establishment and opening of a Food Service Establishment (FSE) in a certain place or establishment.

Note:

  • In case of a change in the registered office of the establishment, which constitutes a change of the establishments location, the entity shall make a new notification (paragraph 5 of article 6 of Law 4442/2016).
  • In case of cessation of any of the activities declared in the notification, the party concerned shall also make a change to the notification.
  • In case of death of the entity as a person: the legal heir must change the details of the notification within 4 months from the date when he/she became aware of the induction, stating in the change of the notification the number of the decision of the relevant Court of First Instance by which the will was published, as well as the certificate of the same court on the non-publication of another will. If the will is a personal will, the above court must declare the will to be the main will. If there is no will, the new body must indicate the number of the succession (Articles 1956 et seq. of the Civil Code). Until the issue of the probate certificate, it is possible to declare a change in the notification in the name of the person concerned, provided that the certificate of next of kin and their responsible declarations on the continuation of the activity by the person concerned is declared (or sent electronically) to the relevant municipality. The new entity is responsible for the operation of the establishment from the day of the change declaration. The new operator must produce the above documents to the competent control authorities on request.
