The right to operate a driving school and a branch thereof is also extended to:
a. natural persons who hold a valid certificate of lawful occupation as an instructor of trainee drivers;
b. legal persons, where one of their members or at least one of their staff holds the status of instructor of trainee drivers and also holds a valid certificate of lawful occupation as an instructor of trainee drivers.

Ownership
In cases of car and motorcycle driving schools, the activity operator must, before submitting the notification, have issued registration certificates for the training vehicles to be used, which belong to the driving school and are used to meet the needs of the driving school to begin operating. Furthermore, these vehicles must have undergone the special and periodic inspection, a Roadworthiness Certificate (DTE) and certificate of a special inspection for compliance of training the vehicles with the requirements of Presidential Decree 51/2012 (Government Gazette, Series I, Issue 101) must have been issued, or an inspection by the competent Directorate for Transport and Communications must have been conducted and the relevant certificate of suitability must have been issued, as appropriate.

Building
Co-location.
Car and motorcycle driving schools, Theory Training Centres for Trainee Drivers (KETHEYO), vocational training schools issuing a Certificate of Professional Competence (PEI), Vocational Training Schools for Hazardous Goods Drivers (SEKOOMEE) and Carriers’ Vocational Training School (SEKAM) may be co-located at the same premises, provided they belong to the same natural or legal person.
In cases of co-location, the following requirements must also be met:
a) all the operating conditions of the above Schools/Centres, as provided for in the relevant provisions, must be complied with;
b) different classrooms must be used if their curricula coincide in terms of scheduling;
c) the reception area and the common areas of the above Schools/Centres may constitute a single space, but must in all cases be different from the classrooms. The use of ancillary spaces must not interfere with use of the classrooms.
Undertakings carrying out administrative operations under KAD 9609.19.11 and insurance intermediary and insurance broker operations under KAD 66.22.10.01 and KAD 66.22.10.05 may also be co located, insofar as they belong to the same natural or legal person.

Building
The driving school premises must be a main-use, single space, must not be part of a residence, and must possess good lighting and sufficient ventilation.

Ownership
The driving school must own or hold at least one training vehicle, which must be classified and insured as a training vehicle and meet the specifications laid down in Presidential Decree 51/2012 (Government Gazette, Series I, Issue 101).

Labour
The activity of the driving school entitles the school to provide practical training and examinations solely for the corresponding categories depending on the training vehicles declared by the school in the notification.

Technical
A sign, clearly visible to the general public, must be posted outside the driving school or its branch stating the following:
a) the indication ‘DRIVING SCHOOL’, in black or blue; and
b) the international distinguishing sign ‘L’, in red.

Ownership
Driving school branches do not hold training vehicles, but use the training vehicles of the driving school owned by the same natural or legal person for their activities. Similarly, instructors of trainee drivers engaged by the driving school are used for the activities of the driving school branch.

Notes When the notification is submitted electronically via the OPS-ADE or www.notifybusiness.gov.gr, it is given a unique number and time stamp, which are generated by the system. The file bearing the unique number will serve as proof of submission of the notification.

Description The competent Directorate of Transport and Communications shall inform the operator of the activity without delay and by any appropriate means of the code/serial number, which shall be registered in the Computerised Applications of the Ministry of Infrastructure and Transport for the purpose of control and supervision.
Notes The code of the driving school is unique; the driving school cannot participate without this code in Qualification and Behavioural Tests (practical tests for citizens to obtain a driving licence).

Forwarding of Notification

Description Within no later than five business days, the competent Directorate for Transport and Communications will forward the notification or change thereto to the Directorate of Road Traffic and Safety of the Ministry of Infrastructure and Transport, the National Transparency Authority, the competent Building Service and the competent Fire Department, as the case may be, and any other department which, in the Directorate’s view, must be made aware of the operation of the activity in order to carry out the statutory inspections. This forwarding takes place electronically via the system or by e-mail without the need to issue a cover document for that purpose.

Inspections of Activity

Description After submission of the notification of operation or from the time the obligation to submit the notification arose, the competent Directorate and other control authorities may carry out inspections to verify the correctness of the notification information and monitor the operator’s compliance with the requirements laid down in Chapter XXXI of Law 4442/2016. The first inspection must be carried out within two months of submission of the initial notification.

Conduct of on-the-spot inspections

Description On-the-spot inspections are carried out by a two-member audit committee set up pursuant to a decision of the Regional Governor on the recommendation of the competent Directorate. Officials of the departments of the competent Region who hold tertiary education degrees may be designated as committee members. The two-member audit committee referred to herein may, at the same time, exercise the supervisory powers exercised to ensure compliance with the operating conditions. During the on-the-spot inspection, the activity operator must make the information related to the subject matter of the audit available to the audit committee and provide a written or verbal explanation of the issues raised.

Conduct of remote inspections

Description Remote inspections are carried out by the directorate competent for carrying out remote inspections, which sends the operator of the activity, via registered letter, a request for submission of the file of supporting documents of Article 5 of the Joint Ministerial Decision, electronically or in hard copy if the operator is unable to send it electronically, with five (5) days of receiving the request. If the deadline for submitting the file lapses without action, an on-the-spot inspection is carried out. The competent authority referred to in Article 2 checks the file submitted and may request verbal or written explanations from the activity operator. A remote inspection report is drawn up in which any infringements are recorded.

Finding of violations – Fines

Description The competent Directorate for Transport and Communications sends a copy of the inspection report to the activity operator by registered post. If violations were found, in the same letter the operator is asked to set out their views on the findings of the inspection and to resolve the violation with five (5) working days of the day following the day on which the letter was received. If the operator of the activity fails to submit their views within the deadline or the views are found by the competent directorate to be unsubstantiated, administrative fines are imposed by the directorate. The decision to impose an administrative find shall be notified to the operator of the activity in a document calling on them to pay the fine within ten (10) working days of receiving the document. If the violation is deemed to be minor, the competent directorate can make a recommendation and set a deadline for compliance. If the operator complies within the deadline set, no fine is imposed. Fines imposed hereunder are collected as public revenue in accordance with the provisions of the Public Revenue Collection Code (KEDE). If a violation is found regarding the notification of this decision, the operator of the activity shall be subject to the penalties referred to in Article 15(1) of Law 4442/2016, and specifically an administrative fine of between two hundred (200) and twelve thousand (12 000) euros.
