Notification of operation of a Theory Training Centre for Candidate Drivers (KETHEYO).
Notes:
The operator of the activity submits an application that is accompanied by the necessary supporting documents (in accordance with the applicable legislation) for approval of operation of a school/vocational training centre granting the Certificate of Professional Competence through the Integrated Information System for Exercise of Activities and Controls (OPS-ADE) of Article 14 of Law 4442/2016, which is accessible through the Public Administration Single Digital Portal (gov.gr-SDP). Until activation of the OPS-ADE for part relating to the approval of the operation of the present activity, the application is submitted on paper or in electronic form at the licensing authority or any Citizen Services Centre (KEP) operating as an Integrated Services Centre (EKE) in accordance with Article 7 of Law 3844/2010 (GG I 63), with authentication of signature if it is not submitted by the operator of the activity in person (natural person or legal representative of a legal person).

Building
The KETHEYO shall consist of at least three (3) separate areas, including one (1) reception area, one (1) classroom and one (1) WC. The premises of the KETHEYO must have the KETHEYO as primary use, must be a single space and not part of a residence. The reception area must be well lit and have adequate ventilation.
The classroom must meet the ratio of 2.0 m²/person, which also determines the maximum number of trainees, rounded down to the nearest whole number.
The classroom must also be a single space, have good lighting, adequate ventilation, good heating and adequate soundproofing.
The WC must be directly accessible from the reception area.
KETHEYOs may not operate in a building that houses the Ministry of Infrastructure and Transport or the Directorates of Transport and Communications and Vehicle Technical Inspection Centres (KTEO) of the country’s regional units.

Professional
The management of studies and responsibility for the proper functioning of the KETHEYO and compliance with the relevant legal provisions is entrusted to a Director of Studies, who must be a car and motorcycle driving instructor with a valid certificate for practising the profession.

Educational
Car and motorcycle driving instructors with a valid certificate for practising the profession may teach at KETHEYOs. Instructors who have had their certificate for practising the profession of instructor revoked due to physical incapacity may teach.
Also eligible to teach are holders of university or technical educational institute degrees or diplomas from Greece or abroad – recognised as equivalent schools – with specialisation in the subject matter to be taught, as follows:
a) For topics relating to vehicle mechanical or technical issues, driving technique, active and passive safety systems and methods, and environmental protection/energy saving, the prospective instructor must hold a degree or diploma from a university or higher technical educational institute or equivalent school whose graduates have the right to undertake engineering projects, or in another field related to the above topics.
b) For topics related to medical conditions and driving, road accident first aid, instructors must hold a degree or diploma from a university or higher technical educational institute or equivalent school, in medicine or nursing.
c) For topics related to road traffic legislation and social conduct/education of drivers, instructors must hold a degree or diploma from a university or higher technical educational institute or equivalent school of Law, Social Sciences or another field relevant to the above topics. Additionally Greek police officers with proven experience in traffic directorates or departments may provide instruction on the above topics.
d) The topics referred to in cases a, b, and c may also be taught by holders of a degree or diploma from a university or higher technical educational institute or equivalent school in a field other than the ones mentioned above, if they have completed training at a vocational training institute in the ‘Driving Instructor’ department.
A list of the names and qualifications of the centre’s director of studies and teaching staff shall be posted in a prominent position within the KETHEYO premises.

Outside the KETHEYO and in a prominent position, a sign must be posted with the words
a) ‘THEORY TRAINING CENTRE FOR CANDIDATE DRIVERS’ in blue or black, and
b) the international symbol ‘L’ in red.

Building
Shared premises A car and motorcycle driving school, KETHEYO, vocational training school for granting a Certificate of Professional Competence (PEI), Vocational Training School for Transportation of Hazardous Loads (SEKOOMEE) and Vocational Training School for Couriers (SEKAM) may share the same premises, provided they belong to the same natural or legal person.
In the case of shared premises, the following are also required:
a) Compliance with all of the requirements for operating the above schools/centres, in accordance with the applicable legal provisions.
b) Use of different classrooms if class times overlap.
c) The reception area and common spaces of the above schools/centres may be shared, but must be separate from classrooms. Use of auxillary spaces must not disturb the use of classrooms.

The notification is submitted by the interested party in electronic form to the competent Directorate of Transport and Communications of the relevant Regional Unit where the Centre for Theoretical Training of Candidate Drivers (KETHEYO) is established and operates. The application at https://openbusiness.mindev.gov.gr assigns the notification a unique serial number, which remains the same even when it is changed, with simple addition of sequential numbering for each change.

The competent Directorate of Transport and Communications communicates, no later than within five (5) working days, the notification or its change to the Directorate of Road Traffic and Safety of the Ministry of Infrastructure and Transport, the National Transparency Authority, the relevant Building Service and the relevant Fire Service, as the case may be, as well as to any other Service which, in its judgment, should be informed of the operation of the activity in order to exercise the inspections provided for by law. Description
On-site inspections are carried out by a two-member inspection committee, established by decision of the Regional Governor following a recommendation by the competent Directorate. Employees of the services of the relevant Region, who are graduates of tertiary education, are appointed as members of the committee. The two-member inspection committee under this decision may simultaneously exercise the inspection powers exercised for compliance with the operating conditions.
During the on-site inspection, the activity operator makes available to the inspection committee the information related to the subject of the inspection and provides written or oral explanation on any issues that arise.

Description
Remote inspections are carried out by the competent Directorate, which, acting as the remote inspection body, sends the activity operator by registered letter a request to submit the file of supporting documents under Article 5 of the Joint Ministerial Decision, electronically or in physical form due to inability to send it electronically, within five (5) working days from receipt of the request. If the deadline for submitting the file passes without action, an on-site inspection is carried out.
The competent authority of Article 2 checks the submitted file and may request oral or written explanations from the activity operator. A report is drawn up for the remote inspection, recording any violations.

Description
The competent Directorate of Transport and Communications of the Regional Unit sends a copy of the inspection report to the activity operator by registered letter. If violations were recorded, with the same letter it invites the operator to state their views on the inspection findings and to remedy the violation within five (5) working days from the day following receipt of the letter.
If the activity operator does not submit written views on time or submits views that are judged unfounded by the competent Directorate, administrative fines are imposed by its decision. The decision imposing the administrative fine is communicated to the activity operator, by a document inviting them to pay the fine within ten (10) working days from receipt of the document.
The fines imposed pursuant to the present provisions are collected as public revenue in accordance with the provisions of the Public Revenue Collection Code (KEDE). If a violation concerning the present notification is established, the sanctions of paragraph 1 of Article 15 of Law 4442/2016 are imposed on the activity operator, specifically an administrative fine from two hundred (200) to twelve thousand (12,000) euros.
