In the event that the above deadline has expired, it shall be deemed that the application of the applicant has been tacitly approved and the licence has been issued, in accordance with Article 14(4) of Law 3844/2010 (Government Gazette, Series I, No 63). In the event of tacit approval as described above, the applicant may request the issuance of the relevant certificate from the Administrative Authority competent for issuing the deed, in accordance with Article 10(4) of Law 3230/2004 (Government Gazette, Series I, No 44).

Urban planning
General Specifications for supported living facility (SLF) buildings, as per Article 13 of Joint Ministerial Decision Δ12/ΓΠ οικ.13107/283.
SLFs must be located within the urban fabric, in areas designated for general or exclusively residential use, close to social services.
In areas with no local spatial plan, the SLF must be located within the urban plan of the town or settlement.

The SLF must have been constructed as per a building permit issued by the competent building authority as ‘residential buildings’, or must be a legally existing or regularised building, in accordance with the provisions of Law 4495/2017, as amended and in force.

Technical
Based on their use, these buildings fall under building use category A – Residential, and are subject to all provisions relating to fire safety in buildings designated as ‘Residential’. Furthermore, SLFs must also possess the following:
• One (1) portable dry powder or water-based fire extinguisher, with an extinguishing efficiency of at least 21A-113B-C, for every 50 square metres of gross floor area. Fire extinguishers shall be placed in conspicuous, easily accessible points by SLF staff. Irrespective of the above calculations, the minimum number of fire extinguishers shall not be less than two (2).
• Emergency lighting in every room, in accordance with the ELOT EN 1838 standard.
• An automated fire detection system covering all areas of the SLF, as per the ELOT EN 54 standard as in force and in accordance with the manufacturer’s specifications.
• Visual alarm devices covering all areas of the SLF, as per the ELOT EN 54-23 standard and in accordance with the manufacturer’s specifications.
• Capability of automatic notification to the Fire Service and the coordinator and/or caretaker of the SLF.
• One (1) portable fire extinguisher rated for Class F fires, to be placed in the kitchen, with a minimum extinguishing efficiency of 25F.
• A gas leak detector (for LPG or natural gas, as applicable), which must meet the requirements of the relevant European or equivalent standards, where gas-powered cooking appliances (LPG or natural gas) are used, and which automatically cuts off the gas supply.

Τhe SLF Operating Regulation lays down the rules governing its operation, the accommodation of its tenants, the duties, responsibilities and obligations of the support staff and the services provided. The Operating Regulation may be based on a relevant standard if such a standard is drawn up by the competent Ministry of Labour, Social Security and Social Solidarity.
The SLF Operating Regulation must be drafted, signed and approved by the management of the organisation and must contain, as a minimum, provisions laying down:
a. The number of residents who will reside in the specific SLF;
b. The type of disability of the residents who will be living in this specific SLF;
c. Procedures for the admission and departure of residents.
d. The number and roles of the members of the support team employed at this particular SLF, and the nature and frequency of the support services provided.

The study must include a sustainability report on the establishment of the SLF, accompanied by a detailed assessment of its operating costs and how they will be covered.
