According to the law, in order for the marriage to take place, whether as a civil marriage or as a marriage solemnised by the Eastern Orthodox church, a licence is required for the mayor of the last place of residence of each of the persons to be married.

Notes:

Every person who is about to be married submits the marriage licence with the required supporting documents to his/her Municipality. The application shall include the name and surname of the persons, their profession, the name of their parents where they were born, the place where they last lived and the place where the marriage is to be performed. ( The application shall include the individual elements listed in the first paragraph of Article 1369 CC, both the person submitting it and the other person, with whom the marriage is about to take place).

    The procedure concerns the issue of an electronic solemn declaration by the applicant or his/her relationships with the other person with whom he/she is to marry, none of the obstacles referred to in Articles 1354, 1356 1357, 1359, 1362, and 1365 of the Civil Code. The procedure concerns the issue of an electronic responsible statement by the person concerned without having to visit an administrative authority or a Point of Single Contact (ΚΕΠ-ΕΚΕ). You can enter the service of issuing the electronic solemn declaration in two (2) ways: (a) by your personal web banking codes in one of the available banks; or (b) by your personal access TAXISnet codes (after logging in once with your web banking codes to confirm your mobile phone number). Then, you will receive confirmation codes with SMS in your mobile bank;The electronic solemn declaration that you will issue is legally equivalent to a solemn declaration bearing a genuine signature and you can either send it electronically or print it out and submit it to a public authority. At the same time, the right of the citizen to physically sign the form of the Solemn Declaration under Law 1599/86 (Article 8) and to submit it to a competent authority as a supporting document for his/her case.

  • 1 Administrative Each of the persons wishing to marry each other in any of the types of marriage defined in Article 1367 of the Civil Code shall address before the marriage is concluded to the mayor or the president of the community of his residence an application requesting that the licence provided for in Article 1368 of the Civil Code be granted to him/her. If this is not a case not falling into the second paragraph of Article 1369 CC, it is requested to make the public notice with the same application, in accordance with the first paragraph of Article 1369 CC.

  • 2 Age Any person who has attained the 18th year of age (adult) shall be capable of any legal act. It is mandatory to submit: a) an extract of the applicants birth certificate, showing the date and year of birth or a birth certificate from the civil registry of the applicant b) in the case of an applicant who is a minor, a declaration by the person having his/her custody that he or she consents to the performance by the applicant of the marriage in question or a certified copy of a final court decision, by which consent was given on the ground that the person having custody refused to give it, or a declaration by the latter that he or she gives consent, made either to a notary or to the magistrate of the minors place of residence, who shall verify, on the basis of documentary evidence attached to the instrument drawn up by them, the authority of the declarant to give consent; if the consent is given by the father and the mother, their signature, certified by the police, on the application is sufficient.

  • 3 Administrative Third party complaints. In any case, the mayor or the president of the Community should wait for a week from the date of the submission of the relevant application by third parties, the absence on the person of a positive condition or the existence on the person or his relationship with him or his or her, in which he or she is to be married. The complaint shall be made by any person in writing and shall be examined, if he or she is accompanied by serious evidence proving the case or expressed in the form of a responsible declaration of Law 105/1969. In the event of such a complaint, the mayor or the President of the Community shall promptly call on the person concerned to challenge it.

Judicial redress

Where the person responsible for issuing the licence refuses to grant it, the competent Single Judge Court of First Instance shall decide irrevocably in accordance with the provisions of Jurisdiction of the Code of Civil Procedure; the judicial decision shall be issued in 10 days following the submission of the application.
