Description
The procedure concerns the actions required to start Type A and Type B trading activities in fertilisers and the issuance of a relevant certificate of compliance with legal requirements.
It is addressed to natural or legal persons that trade in fertilisers:
- to the end user (Fertiliser Trade License of Type A), or
- wholesale and retail (Fertiliser Trade License of Type B).
Exceptions: Natural and legal persons, engaged in trade in fertilisers exclusively to amateur cultivators and in small packages, do not require to submit a commencement announcement for Type A fertilisers trade (Art. 6, MD 9748/ 2012), as defined below, by fertiliser category:
- a) Solid, inorganic and organic fertilisers, simple or complex or mixed, of the three (3) main and secondary nutrients, whether enriched or not with trace elements, as well as mixtures thereof, up to two (2) kg.
- b) Water soluble - crystalline and liquid fertilisers of the main and secondary nutrients, up to 0.5 kg or litres.
- c) Trace elements, or mixtures thereof, of any kind, up to 250 grams or cubic centimetres; and
- d) Fertilisers of the above a), b) and c) cases, to which are added calcium (Ca), phytohormones, enzymes, regulators, vitamins and other similar substances, up to 250 grams or cubiccentimetres.

At each fertiliser trade point, a scientific manager shall be employed at all hours and days of its operation, to assess needs and provide instruc-tions.
When the announcer is a natural person who meets the requirements for the scientific manager role, then he himself/she herself may be des-ignated as the scientific manager of a point of sale and not be obliged to employ another person for this purpose. In case the natural person wishes to create more than one fertiliser store, he/she shall employ as scientific managers in them, staff with the necessary qualifications.
Micro and small businesses may hire a part-time scientist. In this case the businesses are obliged to employ properly trained staff, responsible for the sale of fertilisers.

Educational
The scientific manager shall:
aa) hold a university level degree as Agronomist or Forester, or
bb) hold a university-level degree in some other field, plus a postgraduate specialisation degree in the fields of pedology-plant nutrition, or
cc) hold a domestic technology-level degree from the Departments of Crop Production or Greenhouse Horticulture and Floriculture or Man-agement of Agricultural Holdings or Organic Farming and Food Technology, or a degree from similar specialties of schools in another EU member-state or an equivalent degree or diploma from a similar specialized school in non-EU countries.
dd) have followed an equivalent training in the marketing of fertilisers, as defined in the Presidential Decree 145/2014 issued according to case 2 of subparagraph E.10. of paragraph E of article one of Law 4152/2013 (A 107).

Technical
Appropriate storage conditions for the fertilisers shall be ensured, and safety and environmental protection conditions shall comply with current legislation.

The business shall have an operating license from the Development Directorate of the relevant Regional Unit, in cases where it is required, i.e. if the company produces, packages, mixes or standardises fertilisers, in accordance with the existing provisions.

Technical
Every fertilizer-trading business shall post at the entrance and in a visible place inside the store, a plastic or metal sign, measuring at least 20 cm on one side and 30 cm on the other, which will indicate the name of the scientific manager and his/ her days of employment in the business.

• A copy of a recent Analytic Periodic Declaration (APD) documenting the employment of the scientific manager, along with a copy of the electronic proof of submission to e-EFKA
• A solemn declaration (as per Law 1599/86) of the scientific manager about his/her employment. In case the applicant (interested party) is also the scientific manager, then a solemn declaration by himself/herself about his/her employment in his/her business is submitted.
• A solemn declaration (as per Law 1599/86) of the business legal representative that the business has the required scientific staff. If the legal representative is not appointed in a statute (SA, Unions of Agricultural Cooperatives & Primary Cooperatives), an exact copy of the minutes of the Board of Directors (the term of which must be valid) appointing the legal representative, or the Government Gazette in which the minutes were published, shall be submitted.
