Other An appeal may be brought against this decision by anyone who has a legitimate interest in the Coordinator of the Decentralised Administration concerned within fifteen (15) days from the notification of the decision, in accordance with Articles 227 and 228 of Law 3852/2010 (A’87).

If the period of fifteen (15) working days elapses without the licensee having approved or rejected the request, the requested changes shall be deemed to have been approved and the party concerned is legally operating its business without any additional restriction. In the case of implied approval, the person concerned may request a certificate from the licensee in accordance with Article 10(4) of Law 3230/2004 (A44) and the licensee shall transmit all supporting documents for verification to the Department of Fuel and Energy Services of the Technical Control and Service of the Directorate-General for Vehicles and Facilities of the Ministry of Infrastructure and Transport.

3 Citizenship Natural persons or members of companies, in order to obtain authorisation for the establishment and operation of liquid fuel or mixed gas or purely liquefied petroleum gas service stations of public use are required to be either Greek nationals or citizens of either Member States of the European Union or the European Economic Area (EEA). In exceptional cases, the authorisation may be granted for the establishment and operation of a liquid fuel or mixed or purely liquefied petroleum gas service station to Greek nationals from Russia, North Epirus, Turkey and Egypt, as well as to children born by these persons. Turkeys counterparts at the time of submission of the documentation demonstrates even the validity of the residence card of the Centre for Immigration, after the registration number of that card has been entered in the application. For public limited companies established in the country, no account is taken of the nationality of the shareholders.

4 Administrative The authorisation of a service station or mixed gas service station may, at any time when it is established that the conditions under which it was granted have ceased to exist, be temporarily removed until the defects have been restored, or definitively, by a fully reasoned decision of the authority which granted it.

5 Administrative The issue of the authorisation shall not replace any other authorisations and shall not exempt the holder of the authorisation from the obligation to issue authorisations or other administrative acts provided for in other provisions concerning equipment or parts thereof used in the service of fuel.

6 Urban planning If there is evidence that the service station cannot be further operated either because, in the meantime, adverse traffic conditions have been created (such as magnification or diversification of road level, construction of node at short distances) or because of reasons which constitute an objective inability to operate (such as demolition, impairment of the ground area) or because of the reasons referred to in paragraphs 2 and 3 of Article 185 of Law 4070/2012 (A 82), the licensing authority may prohibit the continuing operation of the service by means of a specific reasoned decision.

7 Administrative Before the expiry of any certificate, the holder of the licence shall be required to submit to the competent authority a new document in force for the continuation of operation; in this case, no new authorisation shall be issued, but information shall be made on the record of the agency with the new supporting document; in this case the licence holder shall be limited to the new documentation submitted and only if it is found that a service is in operation without any certificate being in force as supporting documents, the authorisation shall be withdrawn and the premises of the agency shall be sealed.

Description 1. In case it is found that the legal conditions are met, authorisation shall be granted for an indefinite period of time. 2. The issuing of the offices licence shall be notified to the applicant, the competent Department of the Ministry of the Environment and Energy, the local police department, the relevant Office, the local Public Economic Service and the competent Office, which shall be kept by the Registry of the General Secretariat of Information Systems Inputs/Exit Systems.
