A prerequisite for the granting of a temporary (active) fire protection certificate is completion of the remaining fire protection measures and the installation of equipment provided for in the respective study. This certificate shall also specify any additional or increased fire protection measures and equipment required by the fire department and the deadlines by which they must be completed.

|process_remarks=Η αρμόδια Πυροσβεστική Υπηρεσία (Γραφεία ή Τοπικά Παραρτήματα Προληπτικής και Κατασταλτικής Πυρασφάλειας) δύναται κατόπιν υποβολής σχετικής αίτησης, να εκδίδει άπαξ προσωρινό πιστοποιητικό (ενεργητικής) πυροπροστασίας, και την υποβολή των δικαιολογητικών της 1ης Περίπτωσης του Παραρτήματος Γ της υπ΄ αριθμ. 13/2021 Πυροσβεστικής Διάταξης (5519 B΄), συνοδευόμενη από αιτιολογημένη έκθεση του φορέα, στις επιχειρήσεις - εγκαταστάσεις που:

α.) Εμπίπτουν στο πεδίο εφαρμογής της παρ. 2 του άρθρου 1 της υπ΄ αριθμ. 13/2021 Πυροσβεστικής Διάταξης (5519 Β΄) που δεν έχουν υλοποιήσει πλήρως την υποχρέωσή τους για την εγκατάσταση Μόνιμου Υδροδοτικού Πυροσβεστικού Δικτύου ή Αυτόματου Συστήματος Πυρόσβεσης.
 
−
β.) Εμπίπτουν στο πεδίο εφαρμογής της παρ. 2.1. του άρθρου 1 της υπ΄ αριθμ. 13/2021 Πυροσβεστικής Διάταξης (5519 Β΄) και για τις οποίες διαπιστώνονται αποκλίσεις από τα στοιχεία της μελέτης παθητικής πυροπροστασίας, που επιδρούν στα στοιχεία της μελέτης ενεργητικής πυροπροστασίας (Παράρτημα Β).
 
−
γ.) Εμπίπτουν στο πεδίο εφαρμογής των παρ. 2.2. και 2.3. του άρθρου 1 της υπ΄ αριθμ. 13/2021 Πυροσβεστικής Διάταξης (5519 Β΄) που δεν έχουν υλοποιήσει πλήρως την υποχρέωσή τους για τα στοιχεία δομικής πυροπροστασίας.
 
−
Εφόσον δεν ορίζεται διαφορετική χρονική διάρκεια ισχύος από πυροσβεστικές ή ειδικές διατάξεις πυροπροστασίας, η διάρκεια του προσωρινού πιστοποιητικού (ενεργητικής) πυροπροστασίας δεν μπορεί να υπερβαίνει τους έξι (6) μήνες.
 
−
Σε επιχειρήσεις - εγκαταστάσεις στις οποίες έχει ήδη χορηγηθεί προσωρινό πιστοποιητικό (ενεργητικής) πυροπροστασίας, δεν παρέχεται το δικαίωμα εκ νέου χορήγησης.
 
−
Απαραίτητη προϋπόθεση για τη χορήγηση του προσωρινού πιστοποιητικού (ενεργητικής) πυροπροστασίας, είναι η λήψη και εγκατάσταση των λοιπών προβλεπόμενων στη μελέτη μέτρων και μέσων πυροπροστασίας. Στο πιστοποιητικό αυτό καθορίζονται και τυχόν επιπρόσθετα ή αυξημένα μέτρα και μέσα πυροπροστασίας που θα απαιτηθούν από την Πυροσβεστική Υπηρεσία και ο χρόνος για τον οποίο πρέπει να ληφθούν.

Από την έναρξη ισχύος της υπ΄ αριθμ. 13/2021 Πυροσβεστικής Διάταξης (5519 Β΄) καταργείται η παρ. 63 της υπ’ αριθμ. 3021/19/6/1986 κοινής υπουργικής απόφασης «Περιορισμός πιστοποιητικών και άλλων δικαιολογητικών που απαιτούνται από τις κείμενες διατάξεις για τη διεκπεραίωση υποθέσεων των πολιτών από υπηρεσίες του δημόσιου τομέα» (847 Β΄).

ΥΠΟΣΗΜΕΙΩΣΕΙΣ:
 
−
1. Στην περίπτωση χορήγησης προσωρινού πιστοποιητικού (ενεργητικής) πυροπροστασίας υποβάλλονται όλα τα υποχρεωτικά και λοιπά δικαιολογητικά, εφόσον απαιτούνται, για τα μέτρα και μέσα πυροπροστασίας παθητικής / δομικής και ενεργητικής πυροπροστασίας που έχουν εγκατασταθεί από τις μελέτες πυροπροστασίας, εξαιρουμένων αυτών που δεν έχουν υλοποιηθεί, τα οποία και θα αναγράφονται ρητά στις Υπεύθυνες Δηλώσεις.

2. Πιστοποιητικό ενεργητικής πυροπροστασίας χορηγείται στις περιπτώσεις επιχειρήσεων - εγκαταστάσεων που υπάγονται στο πεδίο εφαρμογής των κανονισμών πυροπροστασίας κτιρίων (π.δ. 41/2018 (Α΄ 80) ή π.δ. 71/1988 (Α΄ 32). Στις επιχειρήσεις - εγκαταστάσεις που υπάγονται στις λοιπές κανονιστικές διατάξεις πυροπροστασίας χορηγείται πιστοποιητικό πυροπροστασίας (Άρθρο 2 της υπ΄ αριθμ. 13/2021 Πυροσβεστικής Διάταξης (5519 Β΄) - Ορισμοί).

3. Σε περιπτώσεις επιχειρήσεων - εγκαταστάσεων, όπου υφίστανται πέραν της μίας (1) εγκεκριμένες μελέτες πυροπροστασίας (όπως βιομηχανική εγκατάσταση με πολλά κτίρια ή κτίρια με διαφορετικές χρήσεις ή που χρησιμοποιεί για τις λειτουργικές του ανάγκες υγραέριο ή εγκαταστάσεις πετρελαιοειδών προϊόντων κλπ.), η Υπεύθυνη Δήλωση αναφέρεται στο σύνολο των εγκεκριμένων μελετών πυροπροστασίας.

4. Η έννοια της παθητικής πυροπροστασίας αναφέρεται σε κτίρια που υπάγονται στο πεδίο εφαρμογής των κανονισμών πυροπροστασίας κτιρίων (π.δ. 41/2018 (Α΄ 80) ή π.δ. 71/1988 (Α΄ 32) (παρ. 2.1. του άρθρου 1 και άρθρου 2 - Ορισμοί της υπ΄ αριθμ. 13/2021 Πυροσβεστικής Διάταξης (5519 Β΄)).

5. Η έννοια της δομικής πυροπροστασίας αναφέρεται σε κτίρια που υπάγονται σε πυροσβεστικές ή ειδικές διατάξεις πυροπροστασίας (παρ. 2.2. και 2.3. του άρθρου 1 και άρθρου 2 - Ορισμοί της υπ΄ αριθμ. 13/2021 Πυροσβεστικής Διάταξης (5519 Β΄)).

6. Σύμφωνα με το άρθρο 8 του π.δ. 41/2018 (80 Α΄) «…..Ο κύριος του έργου οφείλει να τηρεί αρχείο με τα πιστοποιητικά υλικών και δομικών στοιχείων που εγκαταστάθηκαν στο κτίριο. Με την ενεργοποίηση της ηλεκτρονικής ταυτότητας των κτιρίων, τα ανωτέρω πιστοποιητικά αναρτώνται στον σχετικό ηλεκτρονικό φάκελο του κτιρίου και αποτελούν αναπόσπαστα μέρη αυτού.»

The competent fire service (offices or local fire safety prevention and suppression departments) may issue a one-time temporary (active) fire protection certificate, after the submission of the respective application and supporting documents as indicated in Item 1 of Annex C to Fire Service Regulation No 13/2021 (Government Gazette, Series II, No 5519), accompanied by a reasoned report from the operator, to business undertakings and facilities that:
  • a) fall within the scope of Article 1(2) of Fire Service Regulation No 13/2021 (Government Gazette, Series II, No 5519), but have not fully completed their obligation to install a permanent water-based fire suppression network or an automatic fire suppression system.
  • b) fall within the scope of Article 1(2.1) of Fire Service Regulation No 13/2021 (Government Gazette, Series II, No 5519), but for which deviations from the passive fire protection study description have been identified, which affect aspects of the active fire protection study (Annex B).
  • c) fall within the scope of Article 1(2.2) and (2.3) of Fire Service Regulation No 13/2021 (Government Gazette, Series II, No 5519), but which have not fully implemented their obligations with regard to integrated structural fire protection features.

Unless otherwise stipulated by fire department or special fire protection provisions, the duration of the temporary (active) fire protection certificate may not exceed six (6) months.

Undertakings and facilities that have already been granted a temporary (active) fire protection certificate do not have the right to seek reissue.

A prerequisite for the granting of a temporary (active) fire protection certificate is completion of the remaining fire protection measures and the installation of equipment provided for in the respective study. This certificate shall also specify any additional or increased fire protection measures and equipment required by the fire department and the deadlines by which they must be completed.

As of entry into force of Fire Service Regulation No 13/2021 (Government Gazette, Series II, No 5519), paragraph 63 of Joint Ministerial Decision No 3021/19/6/1986 ‘Limitation of certificates and other supporting documents required by the current provisions for the processing of citizens’ cases by public sector services’ is no longer applicable (Government Gazette, Series II, No 847).

Issue of a temporary (active) fire protection certificate

Notes:

  • From the date of entry into force of the information system, in accordance with the accreditation act of the President of the TEI, provided for in the No. PNEN/DACC/933111/3679/2021 Decision of the Secretary of State for Environment and Energy (B 4874), the procedure for the submission, verification, management and monitoring of the workflow for the adoption of this administrative fire protection acts shall be carried out electronically through the information system ‘E-Authorities’, upon request by an authorised engineer and the submission of the necessary documents and evidence. Access to the ‘E-Authorities’, with regard to the adoption of the administrative fire protection acts, shall be carried out through the Single Digital Portal of Public Administration (Gov.gr), which shall be used by all stakeholders in the procedures for the adoption of those acts, namely the competent Firefighting Services (Futures or Local DCFS).
  • Access to ‘e-Licences’ for the issuing of administrative fire protection acts is via the Public Administration’s Single Digital Portal (gov.gr), which is used by all parties involved in procedures for issuing the abovementioned documents, namely the competent fire service (offices or local fire safety prevention and suppression departments) and authorised administrators.

The concept of passive fire protection refers to buildings that fall within the scope of the building fire protection regulations (Presidential Decree No 41/2018 (Government Gazette, Series I, No 80) or Presidential Decree No 71/1988 (Government Gazette, Series I, No 32) (Article 1(2.1) and Article 2 – Definitions pursuant to Fire Service Regulation No 13/2021 (Government Gazette, Series II, No 5519)).
              5. The concept of structural fire protection refers to buildings subject to fire suppression or special fire protection provisions (Article 1(2.2) and (2.3) and Article 2 – Definitions as per Fire Service Regulation No 13/2021 (Government Gazette, Series II, No 5519)).
              6. In particular, pursuant to Article 8 of Law 41/2018 (Government Gazette, Series I, No 80), ‘... the project owner must keep a record of the certificates of materials and structural components installed in the building. With activation of the electronic identity of the buildings, the above certificates can be uploaded to the building’s respective electronic file and form an integral part thereof.’

Solemn Declaration under Article 8 of Law 1599/86 (Government Gazette, Series I, No 75) by the owner-operator, employer or legal representative of the business undertaking or facility, that: a) The fire protection measures and active fire protection equipment, as provided for by the approved study and the fire safety legislation in force, which will be used by the undertaking or facility have been taken and installed, put into operation and are in good working order. b) Active fire protection equipment and systems have been maintained and shall continue to be maintained, in accordance with the requirements of the relevant national European standards, the manufacturers’ manuals and Fire Service Regulation No 12/2012 (Government Gazette, Series II, No 1794), as in force at any given time, and shall continue to be maintained, in accordance with the requirements of the relevant national European standards, the manufacturers’ manuals and Fire Service Regulation No 12/2012 (Government Gazette, Series II, No 1794), as in force at any given time. c) The facility’s personnel shall be organised, trained, and kept up to date on fire safety issues in accordance with the provisions of Fire Service Regulation 14/2014 (Government Gazette, Series II, No 2434), as in force at any given time. d) I am aware that I am obliged to inform a competent engineer prior to any potential alteration or modification of the installation or the provisions indicated in the study, or of any change in the hazard level of the existing facility, so that appropriate corrective measures or approvals can be undertaken or obtained. e) A copy of the fire protection technical file as notified to me by the competent engineer is available at the facility Solemn Declaration
