Administrative
The applicant must be established and carrying out the activity in question in another Member State of the European Union or provide evidence of at least two years of activity in the field of art auctions.

Time limit
The application for the auction, along with the list of the movable monuments to be auctioned, must be submitted at least two months before the auction. An auction held without the prior and timely submission of a request to hold the auction, accompanied by the list of movable monuments, shall be null and void and the movable monuments thus transferred shall be taken over by the State without any formalities.

The auction venue, which must comply with all rules of good maintenance and security, must be alarmed and adequately guarded.

Conditions for non-commission of criminal offenses
There must be no evidence that the movable monuments listed in the auction catalogue have been obtained by theft, illegal excavation or other illegal activity, such as money laundering, or that they have been acquired or exported in violation of the legislation of their State of origin.

The applicant must have relevant professional experience, evidenced in particular by at least two years of involvement in the field of art auctions - The requirement applies in cases of auctions by other natural or legal persons other than antique dealers who have a relevant license.

The applicant must dispose of a suitable shop and storage area located in cities where the Ministry of Culture services responsible for the protection of movable cultural heritage monuments to be auctioned are located.

Labour
If the auction is conducted by a legal person, an Auction Manager shall be appointed, who is required to have the following qualifications: i) a degree or diploma of any Department of any national university or equivalent schools abroad, preferably of the Department of History and Archaeology or the Department of Media Communication and Culture or ii) at least two years of employment in a company organising auctions of cultural goods.
