Prior notification is required to start a vehicle roadside assistance partner. The notification shall be submitted to the Directorate of Transport and Communications of the Regional Unit of the headquarters of the roadside assistance partner. The notification shall contain the necessary information on the activity carried out and shall be submitted by the operator of the activity, who shall be solely responsible for the information contained therein. The notification shall not be accompanied by any supporting documents. The roadside assistance partner shall keep the supporting documents and proof of submission of the notification at the place of activity. After submission of the notification.

Notes:

Interested parties shall submit the initial notification/notification of change/notification of termination via the online system www.notifybusiness.gov.gr. Until this possibility is implemented, the notification shall be submitted in paper or electronic form to the Directorate of Transport and Communications of the Regional Unit of the headquarters of the roadside assistance partner or to any KEP that operates as a Point of Single Contact (EKE). If the details of the original notification of the roadside assistance partners operation are to be changed, the partner shall submit a prior notification of the change using the same procedure as the original notification.

            • 1 Administrative Prior notification is required to start operation as a vehicle roadside assistance partner. The roadside assistance partner shall keep the supporting documents and proof of notification at the place of business.

            • 2 Tax The road assistance partner has launched an activity with the tax authority responsible for the activity of vehicle assistance.

            • 3 Technical Conditions for roadside assistance of vehicles: The roadside assistance partner shall have at least one (1) privately owned truck (platform, tow truck) per continental Regional Unit of operation and on the islands where it operates, with a gross weight of more than four (4) tons, which has a geospatial positioning system (GPS) installed. In addition to the above minimum mandatory vehicles, the roadside assistance partner may have an unlimited number of vehicles of any kind (such as cars, trucks or two-wheelers). The roadside assistance vehicles shall be wholly owned by the roadside assistance partner or held under retention of title or under a lease or leasing contract. If the partner is only a heavy vehicle roadside assistance partner then, instead of the above vehicle, it must own at least one (1) truck over nineteen (19) tons (platform, tow truck).

            • 4 Building Conditions for staging and transhipment areas: The roadside assistance partner has at least one (1) waiting and transhipment station in each P.E. of mainland Greece and on the islands where it operates. The waiting and transhipment station must have: (a) a ground floor office and waiting room, with sufficient space for the reception of the passengers of the vehicles (b) at least one WC (c) at least one telephone connection (d) a computer (e) a device for wireless communication with roadside assistance vehicles (f) a covered ground floor area of sufficient size, with a trench inspection pit or lifting equipment g) parking space for the roadside assistance partners vehicles. The space must be legally existing with respect to the construction and use as a vehicle roadside assistance partner and must meet all requirements to operate as a vehicle roadside assistance partner in accordance with the applicable building and building code regulations, the fire protection regulations, the general and specific planning regulations in force at the time, as well as the building specifications of the legislation specific to the activity. The supporting document Certificate of the main use of the premises by a private engineer is not required for roadside assistance undertakings for vehicles already operating with a certificate of legal operation or a licence and submitting a notification of change pursuant to Article 213 par. 1 ν. 4442/2016 (A108). For the calculation of the minimum number of waiting and transfer stations the P.E. Central Sector, North Sector, West Sector and South Sector of the Region of Attica (former Athens Prefecture) are counted as one Regional Unit.

            • 6 Conditions for non-commission of criminal offenses The natural person who is the operator of the activity or the natural persons representing the legal person must not have been irrevocably convicted of smuggling, trafficking or use of drugs, trafficking in human beings, intentional homicide, attempted homicide, fraud, theft, forgery, counterfeiting, use of forged documents, robbery, desertion, embezzlement, usury, bribery.

            • 7 Labour Conditions for technical staff: The roadside assistance partner shall employ at least the following technical staff on any type of employment relationship and on full-time or part-time contracts: a) In each continental P.E., in the P.E. of Crete, but also in the islands of Evia, Rhodes, Corfu, Corfu, Lesvos, Zakynthos, Kefalonia, Chios, Kos, where they operate, at least four (4) employees, of which at least 50% must be qualified as mechanics or electricians and the rest as drivers. b) Partners offering roadside assistance on islands other than those mentioned above, at least two (2) employees, of which at least 50% must be qualified as mechanics or electricians and the rest as drivers. (c) One (1) mechanic or electrician driver in the (1) one (1) electrician and electricians technician (electricians and engineers) at the waiting and transhipment stations at their disposal. The minimum technical staff may include and count the owner or owners of the roadside assistance partners business, provided they are qualified in accordance with Article 2 of Law No. 3651/2006. For the purpose of calculating the minimum number of staff, the Regional Unit of the Central Sector, Northern Sector, Western Sector and Southern Sector of the Region of Attica (formerly the Prefecture of Athens) are counted as one Regional Unit.

              Notes: Prior to the submission of the notification, the roadside assistance partner must have issued marketing authorisations for the minimum number of trucks referred to in Article 2 of Law 3651/2008 as indicated in the relevant conditions. For the issue of private vehicle registration licences, prior to the submission of the notification, the roadside assistance partner shall submit to the Transport and Communications Directorate of his head office a declaration of commencement of operation by the competent economic service and a responsible statement indicating: ‘(a) the undertaking shall provide roadside assistance services in accordance with Legislative Decree 3651/2008 and Law 4442/2016 and (b) the vehicle with the plate number (or registration number) ........... will be put into circulation as a private roadside assistance truck after the submission of a notification of commencement of operation of the roadside assistance partner under the name ........... and after the replacement of the registration form." The aforementioned trucks shall be put into circulation for roadside assistance services only after the submission of the notification. The Directorate of Transport and Communications, after submission of the above documents, shall issue a registration permit with the remark "NOT FOR TRAFFIC". For the issue of the licence, the following fee shall be paid the vehicle licence fee provided for in Article 26 of Law 2873/2000 (A 285). After the submission of the notification, the Directorate of Transport and Communications, at the request of the roadside assistance partner, accompanied by a copy of the notification, replaces the registration licence form with a form that does not bear the above remark, without the re-payment of the vehicle licence fee of Article 26 of Law 2873/2000 (A 285).

              Notes: Confirmation of an area of main use by a private engineer pursuant to par. 8 of Article 107 of Law 4495/2017, which states the precise location of the property, the total area of the main area following the annexes, the land use certificate by the relevant Building Service and expressly confirms that the site is legally existing in relation to the construction and use as a vehicle road assister and fulfils all the conditions for operating as a road assistance partner in accordance with the applicable building and building regulations, the fire protection Regulation, the applicable general and specific urban provisions, as well as the building specifications of the local legislation specific to that activity. This certificate shall be accompanied by: I) copies of all public documents concerning the planning legality (building permit, revision or update of building permit, approval of small-scale building works, decision of exemption from demolition, legalization permit, certificate of completion of the procedure of inclusion in the suspension of sanctions or certificate of payment of 30% of the single special fine, etc.), II) copies of approved floor plans of the premises where the activity of a vehicle roadside assistance partner is to operate, showing all its premises. Where building specifications require additional elements to be shown on the above approved plans, these may be reproduced on the above copies under the responsibility of the private engineer or a new plan may be drawn up to accompany the above copy. The copies of the approved floor plans are obtained either from the information system for issuing building permits e-Permits, or from the information system for the declaration of unauthorised buildings, or from the formal file of the YDOM, depending on the type of legal act of the above-mentioned case (I) (electronic or paper). Especially for vehicle roadside assistance partners already operating with a certificate of legal operation or a license that submit a notification due to a change of element pursuant to Article 213 par. 1 of Law 4442/2016, the supporting document of the certificate of the main use of the premises is not required.
