Description
This procedure concerns the issuance of an administrative act granted to certify the right to issue a building permit / revision permit and the application, while it is valid, of its urban planning provisions and sizes (construction, coverage, height), which are in force at the time of issuance of the preliminary approval, provided that the building permit / revision permit is issued within the period of validity of the preliminary approval and subject to obtaining and submitting the required approvals provided for in Article 40(1)(b) of Law 4495/2017, during the building permit / revision permit issuance process.

2. The preliminary approval procedure for the issuance of a building permit is optional and concerns all categories of permit issuance of Article 36 of Law 4495/17.

The preliminary approval of a building permit is compulsory in the following cases:
a) Buildings with a surface area added to the structure of more than 3,000 m2 and additions to existing buildings with a total resulting surface area added to the structure of more than 3,000 m2.
b) Where a building permit needs to be issued by services other than the City Planning Agency, a preliminary building approval is compulsory and is granted by the competent City Planning Agency.
c) For the construction of permanent building facilities, projects of particular environmental and residential importance, or projects subject to special inspection as regards building regulations.

competent City Planning Agency, unless more specific provisions provide otherwise. In this case, the survey diagram will be checked by the competent City Planning Agency and sent to the department responsible for issuing the preliminary approval.
