Description

This procedure concerns the issuance of an administrative act granted to certify the right to issue a building permit / revision permit and the application, while it is valid, of its urban planning provisions and sizes (construction, coverage, height), which are in force at the time of issuance of the preliminary approval, provided that the building permit / revision permit is issued within the period of validity of the preliminary approval and subject to obtaining and submitting the required approvals provided for in Article 40(1)(b) of Law 4495/2017, during the building permit / revision permit issuance process.

Notes

The period of validity of the preliminary approval of the revision permit may not exceed the period of validity of the revision permit. By way of exception, if relating to modification of street and building lines or amendment of buildable areas in communal areas, as well as in cases of subsequent inclusion of the area under a cultural heritage or nature protection status, the preliminary approval shall certify the right to build, only at the time of its issue.

Requirements

  • 1 Possession of passwords to enter software Engineers are the sole applicants for the preliminary approval of a building permit and they must hold passwords to the digital services of the Technical Chamber of Greece.

  • 2 Administrative The preliminary approval procedure for the issuance of a building permit is optional and concerns all categories of permit issuance of Article 36 of Law 4495/17. The procedure for the preliminary approval of a revision permit is optional insofar as it concerns a change in urban planning sizes of coverage, height and volume. Alternatively, the written certification of Article 38(2)(b)(ba) and (bb) of Law 4495/17 is required.

  • 3 Administrative The preliminary approval of a building permit is compulsory in the following cases: a) Buildings with a surface area added to the structure of more than 3,000 m2 and additions to existing buildings with a total resulting surface area added to the structure of more than 3,000 m2. b) Where a building permit needs to be issued by services other than the City Planning Agency, a preliminary building approval is compulsory and is granted by the competent City Planning Agency. c) For the construction of permanent building facilities, projects of particular environmental and residential importance, or projects subject to special inspection as regards building regulations.

  • 4 Administrative The preliminary approval is issued exclusively by the competent City Planning Agency, unless more specific provisions provide otherwise. In this case, the survey diagram will be checked by the competent City Planning Agency and sent to the department responsible for issuing the preliminary approval. Investment plans that have been included in Strategic Investments in accordance with the relevant legislative framework on strategic investments.

  • 5 Administrative Preliminary approval is not required for investments that have been or are subject to Law 3986/2011 (Government Gazette, Series I, No 152).

The appeal must be filed within a time limit of thirty (30) days from the notification or otherwise-obtained full knowledge of the act by the applicant by registering it with the City Planning Agency that issued the contested act.Other

Pursuant to Article 23 of Law 4495/17, the Regional Councils for Urban Planning Issues and Disputes review the administrative appeals against enforceable acts or omissions of City Planning Agencies, which are issued during the issuance procedure of the preliminary approvals of building permits.

    Description The title deed is checked to verify the integrity, buildability and time of segmentation of the plot or parcel of land, and the survey diagram is checked as regards compliance with general and specific urban planning provisions and specifications, as well as verification of the information included therein.

    Description The coverage diagram and any required relevant contribution form for parking space acquisition are checked with regard to compliance with the general and specific urban planning provisions and the specifications of the required data, described in Article 39 of Law 4495/17, as well as the proof of legality of existing buildings on the plot or parcel, which are produced under the responsibility of the engineer.

    Notes The checking of the proof of the legality of existing buildings on the plot or parcel involves the verification of the information included in the building permits already issued, as well as any declarations for subjection to the law on unlawful construction, and is limited to the correct matching of the sizes indicated in the plans of the building permits already issued and the plans accompanying declarations of subjection to laws on unlawful construction with those shown in the coverage diagram.

    Description If the City Planning Agency finds omissions or errors in the survey diagram, the administrator of the submitted application will be notified through the information system so they can make the necessary additions or corrections within two (2) months; otherwise, the application with the attached dossier with the studies and supporting documents will be closed in the information system.
