Means of redress or appeal:
Third-country national concerned has the right to appeal against the rejection decision. The application for treatment should be submitted within two (2) months of service of the decision. Applications for treatment are subject to a fee of EUR 50. The request for treatment is submitted to the department that issued the relevant decision, which decides on it within an exclusive period of thirty (30) days from the date of submission.

Ownership
The applicant must hold full ownership and possession of real estate, the main spaces of which will be converted to residential use, with a minimum acquisition value at the time of purchase of two hundred and fifty thousand euro (EUR 250 000). It is noted that the investment must concern a single property, without any restrictions as to the surface area of the main spaces, i.e. the limit of 120 m2 does not apply. The change of use may be carried out by either the buyer or the seller of the property.

The change of use of the property must have been completed after the entry into force of Article 64 of Law 5100/2024, i.e. after 5 April 2024, and before the application for the golden visa is submitted. Where the permit for change of use was issued prior to the publication of the law, applications shall be accepted only where the change of use of the specific properties has been updated or revised for any reason after the publication of the law.

Where the change of use to residential use is carried out in a property consisting of an industrial building or part of an industrial building, or within which an industrial building is located, it must be certified that no industrial activity has been installed and in operation therein for at least the last five (5) years.

In the case of acquisition of real estate through a legal person established in Greece or another EU Member State, the third-country national must demonstrate, by submitting supporting documents, that they are the sole owner of all company shares or other ownership interests.

Furthermore, the agreed consideration or lease amount for the property must have been paid in full by one of the following means: (a) by crossed bank cheque to a payment account of the beneficiary held with a credit institution operating in Greece, (b) by credit transfer, within the meaning of point 24 of Article 4 of Law 4537/2018 (GG I/84), or (c) via a POS terminal installed by a payment service provider operating in Greece, by debiting a credit or debit card of the buyer, to a payment account of the beneficiary held with a payment service provider, within the meaning of point 11 of Article 4 of Law 4537/2018, operating in Greece. The above payment may also be made by the spouse or by relatives by blood or by marriage up to the second degree of the buyer.

In the case of industrial buildings, the engineer’s technical report must also state that no industrial activity has been installed and in operation in the building during the last five (5) years. This shall be verified and certified by the engineer in the technical report, with reference to either a certificate of electricity disconnection issued by HEDNO or the Municipality, or the E2 tax forms of the last five years, or, cumulatively, other documents issued by a tax or other public authority, stating that ‘The change of use is confirmed, as evidenced by the review of the building permit or the approval of small-scale construction works and/or the update of the file and/or the revision of the building permit (the relevant act shall be specified, such as building permit, file update or other), following the entry into force of Article 64 of Law 5100/2024, from ‘’ use to ‘residential’ use, concerning the main spaces of the property, on the basis of which the investment was carried out through the acquisition of real estate falling under point (c) of paragraph 2 of Article 100 of Law 5038/2023, which has been transferred, in full ownership and possession, to (name of investor), by virtue of deed No …/…-…-…’ of the Notary Public , and it is certified that no industrial activity has been installed and in operation in the building in which the property is located during the last five (5) years, as evidenced by the review of the certificate of electricity disconnection and/or the review of the E2 tax forms of the last five years and/or the combined review of documents issued by a tax or other public authority.’
