Citizenship
In order to obtain a licence to establish and operate service stations selling liquid fuel or mixed or pure liquefied gas (LPG) for public use, natural persons or members of companies are required to be either Greek nationals or citizens of Member States of the European Union or of the European Economic Area (EEA). By way of exception, a licence may be granted, on the basis of the provisions of this article on the establishment and operation of a service station for liquid fuel or mixed or pure liquefied gas (LPG), to persons of Greek origin from Russia, North Epirus, Turkey and Egypt, as well as to children born of these persons. When submitting the supporting documents, persons of Greek origin from Turkey shall also present the valid residence card of the Aliens Centre, after the registration number of this card has been entered in the application. For public limited companies with registered office in Greece, the nationality of the shareholders shall not be considered.

a. The licensing authority shall within thirty (30) working days be required to examine the supporting documents provided for. If the legal conditions are met, it issues the establishment licence within the above period.
b. The establishment licence with a complete set of approved plans shall be notified to the applicant, to the relevant Service responsible for granting the building permit, to the port management organisation and to the competent port authority.
c. Extension of an establishment licence
The establishment licence shall be valid for two (2) years and may be extended for a further two (2) years. See step Extension of establishment licence.
d. Amendment of the establishment licence
Where, during the period of validity of the licence, changes are made to the originally approved plans for the installation of the ‘port service station’ or an extension is made with installations provided for in Decision οικ. 33180/351/23-4-2019 (Government Gazette, Series II, No 1454/2019). If the requirements are not met, the licensing authority does not issue the licence applied for to establish a ‘port service station’ and notifies the applicant in writing of the reasons, detailing the deficiency or rejection of each of the supporting documents submitted. a) In case of resubmission, following relevant written notification from the licensing authority, the establishment licence is issued within fifteen (15) working days from the date of resubmission.
b) The establishment licence with a complete set of approved plans shall be notified to the applicant, to the relevant Service responsible for granting the building permit, to the port management organisation and to the competent port authority.
c) Extension of an establishment licence

Description
If the period of thirty (30) working days expires without the licensing Service approving or rejecting the request, the interested party shall be deemed to have legally established the service station undertaking without any additional restriction. Furthermore, in the case of the above tacit approval, the interested party may request a certificate from the licensing authority, in accordance with Article 10(4) of Law 3230/2004 (Government Gazette, Series I, No 44). In the case of tacit approval, the licensing authority shall forward all supporting documents for inspection to the Fuel and Energy Supply Stations Department of the Directorate for Technical Control and Vehicle Service Facilities of the Directorate-General for Vehicles and Facilities of the Ministry of Infrastructure and Transport.

Extension of an establishment licence

Description
The establishment licence shall have a duration of two (2) years and may be extended for a further two (2) years if an application is submitted before the deadline, accompanied by a solemn declaration from the supervising engineer that the construction works have not been completed. In exceptional cases, an additional extension may be granted for a further period of three (3) months after the expiry of the extension for completion of the works. An application for extension of the establishment licence submitted late shall be considered a new application for an establishment licence. In this case, an application must be submitted by the applicant, together with supporting documents 1, 3, 4 and 10. If it is found that, for proven reasons of force majeure, it has not been possible to start the works or complete the construction of the service station, the establishment licence shall be extended for a period equal to the period of force majeure. In the case of tacit approval, the licensing authority shall forward all supporting documents for inspection to the Fuel and Energy Supply Stations Department of the Directorate for Technical Control and Vehicle Service Facilities of the Directorate-General for Vehicles and Facilities of the Ministry of Infrastructure and Transport.

Amendment of the establishment licence

Description
Where, during the period of validity of the licence, changes are made to the originally approved plans for the installation of the ‘port service station’ or an extension is made with installations provided for in Decision οικ. 33180/351/23-4-2019 (Government Gazette, Series I, No 1454/Β/2019), before their implementation, the new supporting documents, plans and technical report describing the changes must be submitted for approval. Approval of the requested changes must take place within fifteen (15) working days from the date of submission of the relevant application. If it is established that the legal conditions are met, the licensing authority shall approve the requested changes.
If they are not met, the above department shall not approve the requested changes and shall inform the applicant in writing of the reasons, detailing the deficiency or rejection of each of the supporting documents submitted.
If, after the expiry of fifteen (15) working days, some of the supporting documents need to be resubmitted, the approval of the requested changes shall be issued within five (5) working days from the date of resubmission.
If the period of fifteen (15) working days elapses without the licensing service approving or rejecting the request, it shall be deemed that the interested party can lawfully implement the changes requested in the ‘port service station’ undertaking without any additional restriction. Furthermore, in the case of the above tacit approval, the interested party may request a certificate from the licensing authority, in accordance with Article 10(4) of Law 3230/2004 (Government Gazette, Series I, No 44). In the case of tacit approval, the licensing authority shall forward all supporting documents for inspection to the Fuel and Energy Supply Stations Department of the Directorate for Technical Control and Vehicle Service Facilities of the Directorate-General for Vehicles and Facilities of the Ministry of Infrastructure and Transport.

The plan shall show the space occupied by the service station, the dimensions of its sides, the location of the building, tanks, fuel pumps and tank ventilation. Also to be marked are the types of neighbouring buildings and facilities and data of articles 5 and 6 of Presidential Decree 1224/1981 (Government Gazette, Series I, No 303) or of Royal Decree 465/1970 (Government Gazette, Series I, No 150) or of Presidential Decree 595/1984 (Government Gazette, Series I, No 218) as applicable in the given case. Also to be noted are the lines delineating the seafront and onshore zone of the port, the length of the quay, the mooring jetty of the vessels, their manoeuvring circle within the port basin, the types of neighbouring buildings and the other uses of the port or tourism port. The topographic diagram must confirm that there are no visible archaeological sites the border of which is less than 100 metres from the ‘port service station’ being established. If there are visible archaeological sites, all buildings and sites located within a radius of one hundred (100) metres from the boundaries of the service station’s premises shall be shown on the diagram. A licence to establish a ‘port service station’ at a distance of less than one hundred (100) metres may also be granted if the Archaeological Service grants the relevant approval. The drawings and technical reports shall be signed by the engineer responsible and shall contain a memorandum setting out the details of the project, the applicant and the designer, and a memorandum setting out the technical details of the construction. The plans and technical reports shall also be delivered in electronic form.

Specifically: aa. Where the applicant is a natural person, he/she attests that:
i. in the last eight years he/she has not received a final conviction of fuel fraud and has not been convicted of fuel smuggling at first instance, without prejudice to the provisions of Law 4177/2013 (Government Gazette, Series I, No 173), as in force;
ii. has the legal right to use and operate the site for the establishment of a ‘port service station’, submitting a legally approved concession decision from the competent port administration and operation body for the use of a port area space for the establishment of a service station, which shall always be issued in accordance with the provisions of Article 24 of Law 2971/2001 (Government Gazette, Series I, No 285) on concessions for port areas, as amended and in force by Article 34 of Law 3153/2003 (Government Gazette, Series I, No 153).
bb. Where the applicant is a legal person, its legal representative shall attest that:
i. during the last eight years, he has not received a final conviction and the legal person he represents has not been finally declared jointly liable for fuel fraud, he was not convicted at first instance and the legal person he represents was not declared jointly responsible for fuel smuggling at first instance, without prejudice to the provisions of Law 4177/2013 (Government Gazette, Series I, No 173), as in force;
ii. the legal person has the right to use and operate the space for the establishment of a ‘port service station’, submitting a legally approved concession decision from the competent port administration and operation body for the use of the port area space for the establishment of a service station, which shall always be issued in accordance with the provisions in force on concessions of areas in the port zone, Article 24 of Law 2971/2001 (Government Gazette, Series I, No 285), as amended and in force by Article 34 of Law 3153/2003 (Government Gazette, Series I, No 153).

Detailed drawings, accompanied by a file detailing the technical characteristics of the construction of the equipment, in four (4) copies on a scale of one to fifty (1:50) or one to twenty (1:20). In particular, the drawings must show the following:
aa. Plan view – section drawing of the service station and any other buildings and installations that require a building permit.
bb. Fuel tank. The drawing shall include dimensions of the tank, means of mounting with all relevant dimensions, fittings and piping connected to the tank, accessories and devices to protect against fuel leakage, as well as the filling materials, or how the ground around the tank is packed.
cc. The location of natural gas dispensers, auxiliary equipment, portable compressed storage means for condensed natural
gas (CNG), the ‘Compact Unit’ of the natural gas tanker parking area.
dd. Interconnections of pumps/distributors and volumetric meters with electrical and fuel networks.
ee. Liquid waste processing system – septic tank. The plan shall include the dimensions, materials, method of construction and method of disposal of the waste.
ff. Centralised electronic fuel management (inflow/outflow) system. The plan shall include the location of the central console, a schematic layout of the whole system with the corresponding wiring and the mode of data transfer.
