Submission of an application for a marriage licence by the person concerned. The application must contain the personal data, listed in the first paragraph of Article 1369 AK, of both the person submitting the application and the other person with whom the marriage is to take place.

Age
Any person who has completed the 18th year of his or her age (adult) shall be capable of any legal act.
It is mandatory:
a) an extract of the applicants birth certificate from the country of birth, showing the date and year of birth b) in case the applicant is a minor, a declaration of the person having custody of the applicant, a certified copy of a final court decision granting such consent on the grounds that the person having custody has refused to give it, or a statement by the person having custody or a declaration by the latter, the consent is given either to a notary public or to the magistrate of the minors place of residence, who shall verify, on the basis of documentary evidence attached to the instrument drawn up by them, the authority of the person giving consent; if the consent is given by the father and the mother, their signature, certified by the police, on the application is sufficient.

Time limit
Third party complaints.
In any case where an application for a marriage licence is submitted, the mayor or the president of the municipality must wait for one week from the day of filing the application for the possible complaint by a third party of the lack of a positive condition in the person of the applicant or of the existence of a marriage impediment in the person of the applicant or in his/her relations with the person with whom he/she is to be married. The complaint shall be made by any person in writing and shall be examined if it is accompanied by serious evidence of the facts complained of or is in the form of a declaration in the form of a solemn declaratio under Law 105/1969.
If a similar complaint is lodged, the mayor or the president of the municipality shall without delay invite the person concerned to oppose it.

Description Immediately after completion of the one-week period referred to in the preceding Article, without the lodging of any complaints, or, in the event of complaints, immediately after the hearing of the spouse of which they relate and in any event within a reasonable period of time from the date on which the mayor was invited and did not arrive, he/she mayor must grant the licence without further delay.
