Description

The procedure concerns the issue of a document certifying permanent residence to citizens of the European Union, the countries of the European Economic Area and the Swiss Confederation, who have resided in the Greek territory lawfully for a period of five years, or for the period provided for in Article 14 of the P.D. 106/2007, as appropriate.

        Request for treatment or hierarchical appeal pursuant to article 24 of Law 2690/1999. The person concerned may request, either from the administrative authority which issued the act, its revocation or amendment (application for cure), or from the authority which is in charge of the authority which issued the act (Attica and Thessaloniki Aliens Directorates, Chora Police Directorates), its annulment (hierarchical appeal). The administrative authority to which the application is submitted must notify the person concerned of its decision on the application within thirty (30) days at the latest, unless a different deadline is provided for by special provisions.

            • 1 Citizenship The issue of the Certificate of Registration for Citizens of the Union requires the possession of citizenship of a Member State of the European Union, a country of the European Economic Area or the Swiss Confederation.

            • 2 Establishment The issuance of the Permanent Residence Certificate for Citizens of the Union shall be subject to the condition that the citizens of the Union and the persons referred to in par. 2 of article 2 of Presidential Decree 106/2007, who legally reside with the Union citizen have legally resided in Greece for a continuous period of five years.

            • 3 Labour Union citizens have the right of permanent residence before reaching five years of continuous residence in the following cases: (a) they are employed or engaged in an independent economic activity and, at the time they cease to work in Greece, they have reached the age determined by national law for the acquisition of rights to an old-age pension, or they are employed and have ceased to be employed due to early retirement, provided that they have worked in the Greek territory for at least the previous twelve months and have resided there continuously for more than three years. If the right to an old-age pension is not recognised for certain categories of self-employed persons, the persons concerned shall acquire the right of permanent residence when they reach the age of 60, (b) they are employed or engaged in an independent financial activity and have resided continuously for more than two years in Greece, if they have ceased to work due to permanent incapacity to work. If this incapacity is the consequence of an accident at work or other occupational disease, which confers a benefit recognised in whole or in part by the competent institution of the Country, no conditions shall be imposed on the duration of residence, (c) they are employed or engaged in an independent financial activity and, after three years of continuous employment and residence in the Country, they engage in an employed or independent economic activity in another Member State and maintain their place of residence in Greece, to which they return, principally, daily or at least once a week.

            • 4 Family Regardless of their nationality, the family members of an employee or self-employed person, who reside with him/her in Greece, have the right of permanent residence, before the completion of five years of continuous residence, provided that the employee or self-employed person has acquired the right of permanent residence in the country in accordance with paragraph 1 of article 14 of Presidential Decree 106/2007. In addition, in the event that the employee or self-employed person died while still working but before acquiring permanent residence status in Greece under paragraph 1, the family members of the employee or self-employed person, regardless of their nationality, who reside with the employee or self-employed person, have the right of permanent residence, provided that:(a) the wage earner or self-employed person resided continuously, until his death, for two years in the Greek territory; or (b) his death was due to an accident at work or occupational disease; or (c) the surviving spouse has lost his/her Greek citizenship due to his/her marriage to the employee or self-employed person.

            • 5 Conditions for non-commission of criminal offenses The issuance of the Permanent Residence Certificate for Union citizens presupposes that no restrictions have been imposed on the freedom of movement and residence of Union citizens residing in the Greek territory for reasons of public order or public security.

              Notes: In order to prove legal residence, Union citizens are required to prove for a continuous period of five years that they meet the requirements of Article 7 of Decree 106/2007 (i.e. that they are employed or self-employed, economically inactive persons, students or family members). In addition, according to Article 13 par. 2 of PD 106/2007, the continuity of residence is not affected by temporary absences not exceeding a total of six months per year, nor by absences of longer duration for the fulfilment of compulsory military service or by an absence of a maximum of twelve consecutive months for serious reasons, in particular pregnancy and maternity, serious illness, studies or vocational training or a posting to another Member State or a third country. Finally, according to Article 18 of Decree-Law 106/2007, the continuity of residence shall be certified by any appropriate means of proof provided for in the legislation in force. The continuity of residence is interrupted by any expulsion decision enforced in accordance with the law against the person concerned.
