Description

This procedure concerns the issuance of a marriage licence to a foreign national legally residing in Greece. Documents of a foreign national whose State has acceded to the Hague Convention are accepted only if bearing an Apostille stamp and translated into Greek by a Greek translator. For countries that are not parties to the Hague Convention, documents must be certified by the Greek Consulate in that country and translated by a Greek translator.

Title

Each future spouse shall submit the marriage licence application together with the required supporting documents to the municipality of his or her residence. The application must include the first names and surnames of the parties, their occupations, their parents’ names, their place of birth, their last place of residence and the place where the marriage is to take place.

        If the authority competent to issue the licence refuses to grant it, the competent Magistrates’ Court will decide irrevocably in accordance with the provisions on voluntary jurisdiction in the Code of Civil Procedure. The decision will be issued within 10 days from the submission of the application.

            • 1 Administrative Submission of an application for a marriage licence by the applicant himself/herself. The application must include the personal details referred to in the first paragraph of Article 1369 of the Civil Code, both of the person submitting the application and of the other person with whom the marriage is to be concluded.

            • 2 Age Any person who has reached the age of 18 years (adult) shall have legal capacity for all legal acts. The following must be submitted: (a) an extract of the applicant’s birth certificate issued by the country of birth, indicating the date and year of birth;(b) where the applicant is a minor, a declaration by the person having custody stating that he or she consents to the conclusion of the specific marriage, or a certified copy of a final court decision granting the relevant consent due to refusal by the person having custody to grant such consent; alternatively, a declaration by the latter granting consent. The declaration of consent shall be made either before a notary public or before the magistrate judge of the minor’s place of residence, who shall verify, on the basis of documentary evidence attached to the act drawn up by them, the authority of the declarant to grant consent. Where consent is granted by both the father and the mother, their signatures certified by the police on the application shall suffice.

            • 3 Time limit Third-party objections. In every case of submission of an application for the granting of a marriage licence, the mayor or the president of the community shall wait for one week from the date of submission of the relevant application for any possible objection by third parties concerning the absence, in the applicant’s case, of any positive requirement or the existence, in relation either to the applicant or to his or her relationship with the person with whom the marriage is to be concluded, of any impediment to marriage. The objection may be submitted in writing by any person and shall be examined provided that it is accompanied by serious evidence proving the alleged fact or is formulated in the form of a solemn declaration under Legislative Decree No 105/1969. In the event of submission of such an objection, the mayor or the president of the community shall immediately invite the interested party to contest it.
