|process_remarks=In the context of the rules of the internal market of the European Union, each Member State has the power to legislate to define a specific profession by holding specific professional qualifications, which are professional qualifications acquired on the national territory. This constitutes an obstacle to the free movement of professionals within the European Union. As a solution to this problem, the freedom of movement of professionals has been adopted by Directive 2005/36/EC with a view to establishing rules facilitating the mutual recognition of professional qualifications between Member States. The Presidential Decree 38/2010 ‘Adaptation of Greek legislation to Directive 2005/36/EC of the European Parliament and of the Council of 7 September 2005 on the recognition of professional qualifications and other provisions’ (VAT 78 p.A.), as amended and in force, incorporates the Directives: (a) 2005/36/EC of the European Parliament and of the Council of 7 September 2005 on the recognition of professional qualifications, (b) 2006/20/EC, as amended and applicable, as amended and applicable, incorporation of the Directives 2005/36/EC of certain persons in the area of the European Parliament and of the Council of the Council of the Member States of Accession of certain Member States of the European Parliament and of the Council of the Council of the Member States of the European Union, concerning the Member States’stexhastelements relating to the Member States concerned.

Under the rules of the European Union’s Internal Market, each Member State is entitled to regulate access to specific professions by means of specific professional qualifications acquired within said Member State’s territory. This constitutes an obstacle to the free movement of professionals within the European Union. To address this issue, Directive 2005/36/EC was adopted to establish a framework for facilitating the mutual recognition of professional qualifications between Member States. Pursuant to Article 59(1)(c) of Directive 2005/36/EC, as applicable, the Department of Application of European Legislation (T.E.T.N.) shall, on request, issue attestations to the European Union nationals of qualifications who wish to move and establish themselves in other countries of application of that Directive. Excludes the following professions: Doctors, Pharmacopoeia, nurses, Midwives, Dentists, for whom the above attestations are issued by the regions, who have issued the Greek licence to pursue a profession and architects, for which the above attestations are issued by the Technical Chamber of Greece.
