Description
The procedure concerns approval for natural or legal persons to lease marine recreational equipment. Approval to lease marine recreational equipment may also be granted to a natural person who does not fulfil some of the conditions laid down, provided that they appoint a person who fulfils all the qualifications as the person with sole responsibility for the exercise of the activity. The approval to lease shall be issued in the name of the natural person and shall indicate the details of the person with sole responsibility for the lease of the marine recreational equipment. The approval to lease shall be issued in the name of the natural person and shall indicate the details of their legal representative and the details of the legal representative of the person with sole responsibility for the lease of the marine recreational equipment. The application submitted by the operator of the activity during the first stage of the procedure shall include the following information:
a) all marine recreational equipment, by type and number of units, for which a leasing request has been made and, where appropriate, the number of high-speed marine craft used to tow marine recreational equipment;
b) the location of the activity, the point on the seashore/beach or point at sea, determined exclusively by geographical position, where it is requested to operate the activities and any alternatives;
c) the starting point for motorised marine recreational equipment, especially a point on the seashore/beach, a point at sea, a floating platform, a remenzo or a ship;
d) the details of the person with sole responsibility for carrying out the activity and/or the additional person(s) responsible for carrying out the activity.

Conditions for non-commission of criminal offenses
They must not have been convicted for the offenses under case a) of Article 8(1) of Law 3528/2007 (Government Gazette Series I, No. 26), or for the offences of espionage, smuggling or tax evasion, or for violation of C.L. 192/1936 (Government Gazette Series I, No 438), or if they have been convicted, for 5 years to have elapsed from the irrevocable conviction for misdemeanors and 10 years to have elapsed since the irrevocable conviction for criminal offences.

a) the applicant must hold any category of license to coach water skiing from the General Secretariat of Sports (G.G.A.) or have a diploma from the Department of Physical Education and Sports Science (T.E.F.A.A.) with specialisation in water skiing or a valid water ski instructor’s license,
b) the applicant must have at least 2 years’ experience, with a minimum duration of 60 days for each year, as a worker in a undertaking which is legally licensed to lease marine recreational equipment towed by a high speed craft, during which experience the applicant worked with marine recreational equipment towed by a high-speed craft, as the operator of the craft. If the request being submitted involves operating a sea parachute, during a minimum of
one of the 2 years’ experience referred to in the previous subparagraph the applicant must have worked towing sea parachutes as a worker in an undertaking which is legally licensed to lease marine recreational equipment which is towed from a high speed craft.

Description
The responsible three-member committee referred to in Article 35 of the General Ports Regulation No 20 shall examine the interested party’s request. The location (post) or point in the sea, the types of recreational marine equipment to be leased out and the maximum number of them (units) shall be decided by the said committee referred to in Article 35, which shall take into account, for example, the navigation safety and the safety of swimmers, the avoidance of possible friction between lessors due to proximity, the possible creation of operational problems due to the parallel or simultaneous use (circulation) of similar or different types of marine recreational equipment in that specific or wider sea area, and the protection of the environment according to the specificities and special features of each area.
