The third-country national concerned has the right to appeal against the rejection decision. The application for treatment should be submitted within two (2) months of service of the decision. Applications for treatment are subject to a fee of EUR fifty (50). The request for treatment is submitted to the department that issued the relevant decision, which decides on it within an exclusive period of thirty (30) days from the date of submission.

In order for applicants to obtain a national visa, their secondment in the context of an inter-company transfer must have been authorised by the competent service of the Ministry of Migration and Asylum. In order for the approval to be issued, the company’s legal representative in Greece, where the employee is to be posted, must submit an application and the required supporting documents.

Capacity
Third-country nationals who wish to be seconded from the group company in a third country to the group company in Greece, must hold one of the prescribed positions in the company in the third country, namely, either that of management executive, skilled worker, or trainee employee.

Prior Service
They must have been employed in the third-country company a specific period of time before applying for secondment to the group company in Greece and/or other EU Member States. More specifically, if they are a management executive or skilled worker, they must have worked at the company for 12 months, and if they are a trainee employee they must have worked at the company for six months.

Labour
They must maintain an employment relationship with the company in the third country and be remunerated by the company in the third country, and this must be documented by the employment contract with the third-country and the assignment letter from the company in the third country, which must be submitted. It should be noted that the assignment letter must include a detailed description of the period of secondment to the group company in Greece (and in other EU member-states, if they are to be posted to more than one member-state).
