Facilities and works resulting from the technical planning of projects or activities at a stage following the issuance of their Decisions Approving Technical Terms (AEPO), such as construction site facilities, dump sites, motorist service stations, service and maintenance centres for projects or activities, toll stations, anti-noise protection works, clarification of technical measures and terms of the project’s AEPO, are approved through the submission and assessment of a Technical Environmental Study (TES) to the authority responsible for environmental licensing. The TES is approved by decision of the Director General of Environmental Policy of the Ministry of Environment (projects/activities of Subcategory A1) and the Secretary General of the Decentralised Administration (of the project concerned) (projects/activities of Subcategory A2).

Application for review or administrative appeal in accordance with Section 24 of Law 2690/1999. Applicants may request either that the administrative authority which issued the act revoke or amend it (request for review), or that the authority having jurisdiction over the authority which issued the act annul it (appeal). The administrative authority to which the relevant application is submitted must notify the applicant of its decision on the application no later than within thirty (30) days, unless a different deadline is set under specific provisions.

1 Administrative Necessary conditions for the submission and approval of the TES are: (a) the general impact assessment and the provision of general and/or specific terms and restrictions for such facilities and works and operations in the Decision Approving Technical Terms (AEPO); and b) the explicit provision, in the AEPO of the project or activity, of the possibility to submit and approve a TES.
